LABOR CONDITIONS

Period of test

Constitutes the initial stage of the work contract whose object on the part of the employer is to verify the conditions and aptitudes of the worker and on the part of this one, the convenience of the conditions of the contracted work.

The Maxima duration of the period of test is the following one:

30 (thirty) days for not described working personnel of the domestic service

60 (sixty) days for described workers or apprentices, and technical workers highly specialized, the parts could be suitable a different period conforms the modalities of the work.

During the period of test, anyone of the parts will be able to give by finished the contract of work without incurring responsibility some, is not applied to the advance warning nor indemnification by dismissal.

At the end of the period of test and in case of continuity in the work, the period of test to all the legal effects is computed.
 

Schedule of Work

The labor ordinary day will not have to exceed the maximum of 8 (eight) hours daily or 48 (forty and eight) hours weekly for diurnal work, and 7 (seven) hours daily or 42 (forty and two) hours weekly for nocturnal work. The mixed day of work is the one that includes periods of time between the days diurnal and nocturnal. Its Maxima duration will be of 7.5 (seven and average) hours daily and forty and five (45) hours in the week.

The Maxima day of diurnal work for mayores of 15 (fifteen) years and minors of 18 (ten and eight) years is of 6 (six) hours per day or 36 (thirty and six) hours weekly.

Diurnal schedule is the developed one within the rank from the 06:00 to the 20:00 hours.

Nocturnal schedule is the developed one within the rank from the 20:00 to the 06:00 hours.
 

Extraordinary hours extraordinary schedule

Is considered the excess in the schedule of work established formally, which will not be able to exceed three hours daily nor to altogether exceed fifty and seven hours per week, except for exceptions anticipated in the Labor Code. The extraordinary hours will be remunerated of the following way:

  1. Diurnal hours working days (of Monday to Saturday) from 6:00 to 20:00 hs. with 50% of surcharge on the normal daily wage.
    Form of calculation: wage hour x 50% + wage hour.
  2. Diurnal hours (Sundays and holidays) from 6:00 to 20:00, with surcharge of 100% on the normal daily wage.
    Form of calculation: wage hour x 100% + wage hour.
  3. Nocturnal hours (of Monday to Sunday) from 20:00 to 6:00 hs., with surcharge of 30% by nocturnal work and 100% by extraordinary work on the normal daily wage.
    Form of calculation: wage hour x 130% + wage hour.

The superior hierarchic personnel (managers, submanagers, heads and assistant managers) will perceive by the excess of worked hours (superior to 8 hours), the equivalent one to the normal payment (without surcharge);
 

Indirect labor costs

At the moment the monthly contribution to the Instituto de Prevision Social in the following proportion is obligatory:

- In charge of Employee 9.00% on perceived wage
- In charge of Employer 14.00% on paid wage
